Importing peptides: what FDA’s import rules say
How FDA treats imported peptides: the personal importation policy and its limits, detention and refusal, and why 'research' labels don't change the analysis.
The short answer ·
Imported drugs are subject to FDA review at the border. FDA's personal importation policy is enforcement discretion, not a right. It describes limited situations (generally a 90-day personal supply of a drug for a serious condition with no US alternative, not promoted to US residents) in which FDA may allow entry.
Unapproved injectable peptides ordered online usually do not fit, and shipments can be detained and refused. Federal cases in 2026 involved peptides imported from China and elsewhere.
Much of the peptide supply chain runs through imports. Court filings in the Paradigm Peptides case showed products imported from China, India and other countries, according to CBS News. The April 2026 Utah indictment alleges peptides obtained from China through a middleman. So the import rules matter for sellers and buyers alike.
Does FDA review imported peptides at the border?
Drugs offered for import into the US are subject to FDA review. If an article appears to be unapproved, misbranded or adulterated, FDA can detain it and ultimately refuse admission. The importer can respond, but the burden is on them. Customs and Border Protection works alongside FDA at ports and international mail facilities.
What is the personal importation policy?
FDA’s personal importation page describes when it may use discretion to allow an individual to import a drug for personal use. Factors it lists include a serious condition, no effective US treatment, no commercialization or promotion to US residents, no unreasonable risk, a supply of generally not more than 90 days, and the name of the US-licensed doctor responsible for treatment. FDA stresses this is guidance on enforcement discretion, not a legal entitlement.
An unapproved injectable peptide ordered from a website that markets to US buyers rarely fits those factors.
What about domestic sellers that import?
A website with a US address can still be importing its stock. Two of the companies that received FDA letters list addresses abroad: USApeptide.com (Germany) and GLP-1 Solution (Berlin). Sellers who import bulk powder and repackage it face misbranding exposure if their labels misstate the manufacturer or distributor. That labeling failure is central to the Utah indictment (report).
What are the practical takeaways?
- A “research use only” label does not change how FDA reviews a shipment.
- A certificate of analysis inside the box is not evidence of where the product was made. Check the lab’s verification system and whether the lot on the certificate matches the vial (how to verify a COA).
- State law can add requirements on top of federal rules.

Can customs seize peptides?
FDA can detain and refuse admission of drugs that appear unapproved or misbranded; CBP works with FDA at ports and mail facilities. Refused goods may be destroyed or returned.
Is it legal to order peptides from China?
Ordering an unapproved drug from abroad does not make it lawful. FDA's personal-importation policy is discretionary and narrow. Federal prosecutions in 2026 involved peptides imported from China.
