FDA warning letters to peptide sellers: what they are and how to read one
What an FDA warning letter is, what it is not, how to find and read one, and the pattern in letters to peptide sellers from December 2024 to August 2026.
The short answer ·
An FDA warning letter is a formal notice that the agency believes a company is violating the FD&C Act. It asks for a written response (usually within 15 working or business days) and warns of possible seizure or injunction. It is not a court judgment, fine or shutdown order.
FDA posts letters at fda.gov. Peptide-seller letters since 2024 all say the products are unapproved new drugs and that 'research use only' labels did not change that.
What is an FDA warning letter?
FDA describes warning letters as notices to companies of “significant violations” that it expects to be corrected. They are informal and advisory in a legal sense: FDA’s way of giving a company the chance to fix things before it escalates. Every letter we track ends with a request for a written response and a warning that failing to fix the problem “may result in legal action including, without limitation, seizure and injunction.”
What is a warning letter not?
- Not a conviction or court finding. The company may disagree and say so in its response.
- Not a shutdown order. Many recipients’ websites still respond after the letter; our status logs record what we observed and when.
- Not exhaustive. Letters state they are “not intended to be an all-inclusive list of the violations.”
What does a peptide warning letter contain?
Using the Peptide Partners letter (August 24, 2026) as a template:
- Header: reference number (MARCS-CMS 735063), date, delivery method, recipient name and address, issuing office (CDER).
- Review: what FDA looked at and when (“a review of your website https://peptide.partners/ in July 2026”).
- Products: the specific products, quoted by the seller’s own names (“GLP-3 Reta (Retatrutide)”).
- Intended-use evidence: quotes from product pages showing human use.
- Legal conclusion: drugs under 201(g)(1), new drugs under 201(p), no approved application, violations of 301(d) and 505(a).
- RUO footnote: why the disclaimer did not change the analysis.
- Response request: 15 business days, to FDAAdvisory@fda.hhs.gov.
What pattern do the 2024 to 2026 letters show?
For every letter in our log, with a link to each one on fda.gov, see the dated list of FDA warning letters to peptide sellers.
| Date | Recipients (posted) | Product themes |
|---|---|---|
| Dec 10, 2024 | Swisschems; Summit Research Peptides; others | Semaglutide, retatrutide, other GLP-1 class |
| Feb 26, 2025 | USApeptide.com | Semaglutide, tirzepatide (misbranding added) |
| Sep 9, 2025 | GLP-1 Solution and compounded-GLP-1 sellers | Retatrutide; misleading compounded-drug claims |
| Mar 31, 2026 | Gram Peptides; Prime Sciences | Retatrutide, tirzepatide, cagrilintide, mazdutide, BAC water |
| Aug 24, 2026 | Five sellers incl. Peptide Partners, Royal Peptides | Adds SS-31, PT-141, tesamorelin; BAC water as a drug |
Two shifts stand out. Letters moved from GLP-1 analogs only toward a wider set of injectables. And bacteriostatic water went from an accessory to a named unapproved drug. Each entry links to the letter in our tracker.
How can you check a company yourself?
Search FDA’s database by the company’s legal name, any “dba” name, and the website domain. Letters are often addressed to an LLC, as with “TXP Innovations LLC dba Tex Peptides.” No result does not prove there was no letter. FDA does not post everything immediately, and some actions are not letters at all. For criminal matters, search justice.gov press releases by company and owner name.

All newsFrequently asked questions
Does an FDA warning letter mean a company was shut down?
No. It is a notice and request for correction. Further action such as seizure, injunction or criminal referral is possible but separate.
How do I look up whether a peptide company got a warning letter?
Search FDA's warning letter database by company name, and also try the domain name and any trading names, since letters are sometimes addressed to an LLC or 'dba' name.
What is a close-out letter?
FDA may issue a close-out letter after it verifies a company has corrected the violations in a warning letter. Close-out letters are posted with the original letter when issued.
